Rules & Regulations

PLEASE NOTE: It is your sole responsibility to review and understand your employer’s policies regarding your eligibility to participate in this contest. If you are participating in violation of your employer’s policies, you may be disqualified from entering or receiving an award. Sitetracker, Inc. (“Sitetracker”) disclaims any and all liability or responsibility for disputes arising between an employee and their employer related to this matter, and awards will only be awarded in compliance with the employer’s policies.

GOVERNMENT EMPLOYEES: Sitetracker is committed to complying with government gift and ethics rules and therefore government employees are not eligible.

If you do not agree with this provision and these Official Rules, please do not enter this Contest.

COMMON TERMS USED IN THESE RULES:

These are the official rules that govern how the Sitetracker Industry Awards “Heroes of Telecom” (the “Contest”).

In these rules, “we,” “our,” and “us” refer to Sitetracker, Inc., the sponsor of this Contest. “You” and “Company” refers to an eligible Contest entrant.

CONTEST DESCRIPTION AND WHO CAN ENTER:

This is a skill-based Contest.

The objective of the Contest is to celebrate the “Heroes of Telecom”. There are six awards:

  1. Most innovative Telecom Company (company award)
  2. Best Corporate Responsibility (company award)
  3. Best Company Culture (company award)
  4. Project Manager of the Year (individual award)
  5. Most Influential Woman in Telecom (individual award)
  6. Judges Choice

The first three awards are company awards and the last two awards are individual awards. Judges Choice is not eligible for submissions and will be awarded to company with a non-winning entry.

Company Awards

If a company is being nominated the person making the submission must be an employee of the company and have consent from their company to include it in the nomination and all details submitted. A person is not able to nominate a company it is not employed by. But a non-employee can advise a company about the Contest and assist with the submission provided the submission is ultimately made by an employee. There is no limit on the number of times an individual or company can be entered or be nominated.

Individual Awards

For the individual awards, a person can nominate themselves or another person is able to nominate an individual. IMPORTANT: Before nominating an individual, the person making the nomination must get the such person’s permission to be included in a nomination including the use of his/her name and all details submitted. We will contact the person who was nominated, and they must confirm that he or she gave consent to be submitted for an individual award and complete any documentation we require. The submission will not be valid until we are able to get such confirmation.

You are eligible to enter this Contest if you meet the following requirements at time entry:

  • For Individuals: You are a legal resident of the United States, 18 of age or older, prior to submitting or being submitted for an entry into this Contest; For Corproation: You must be domiciled in the United States; and
  • You are NOT an employee of Sitetracker or an employee of a Sitetracker subsidiary; and
  • You are NOT involved in any part of the administration and execution of this Contest; and
  • You are NOT an immediate family (parent, sibling, spouse, or child) or household member of a Sitetracker employee, an employee of a Sitetracker subsidiary, or a person involved in any part of the administration and execution of this Contest.

This Contest is void outside the geographic area described above and wherever else prohibited by law.

The Contest is hosted in the United States, and entry information is collected on computers in the United States. This Contest will be governed by the laws of the State of New York, and you consent to the exclusive jurisdiction and venue of the courts of New York County, New York for any disputes arising out of this Contest.

WHAT ARE THE START AND END DATES?

The Contest starts on September 20, 2019 and ends on October 30, 2019 at 11:59pm Eastern Time (“Entry Period”).

WHAT CONSTITUTES AN ELIGIBLE ENTRY? 

To be eligible for judging an entry must meet the following requirements:

  • Your entry must be in the English language;
  • your entry must be your own original work or have permission from anyone that assisted with the entry;
  • your entry must not contain any information that is confidential or proprietary;
  • you must have obtained any and all consents, approvals or licenses required for you to submit your entry; and
  • your entry must not otherwise violate the rights of any other person or company by using their trademarks, logos, names or images without their express written consent.

Entries may NOT contain, as determined by us, in our sole and absolute discretion, any content that:

  • is sexually explicit, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing) or a particular political agenda;
  • is obscene or offensive;
  • defames, misrepresents or contains disparaging remarks about other people or companies; or
  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or violates any law.

We reserve the right to reject any entry, in our sole and absolute discretion, that we determine does not meet the above criteria.

HOW DO I ENTER?

In order to participate in this Contest, you must go to the Contest Web site at www.sitetracker.com/heroes-2019 and complete and submit the online entry form, including submission of your entry, as instructed. To be a valid submission the entry must at a minimum: i) answer all the questions; ii) provide a response for 500 words or more to each question (where applicable); iii) provide relevant example related to the telecom industry as determined by the Sponsor in its sole discretion.

You may submit more than one entry in any category or nominate more than one person for an individual award. You may be chosen as a finalist more than once but each individual and company may only be an Award winner for one category.

We are not responsible for entries that we do not receive for any reason, or for entries that we receive but are not decipherable for any reason. We will automatically disqualify:

  • Any incomplete or illegible entry; and
  • Any entries that we receive from you that are in excess of the entry limit described above.

HOW WILL MY ENTRY BE POTENTIALLY USED? 

Other than what is set forth below, we are not claiming any ownership rights to your entry. However, by submitting your entry, you:

  • are granting us an irrevocable, royalty-free, worldwide right and license to: (i) use, review, your entry and all its content in connection with this Contest; and (ii) feature you (if applicable), your company, employees, entry and all content in connection with marketing, sale, or promotion activities (including but not limited to internal and external sales meetings, conference presentations, tradeshows, marketing and advertising materials, and screen shots in press releases) in all media (now known or later developed)
  • agree to sign any necessary documentation that may be required for us and our designees to make use of the rights you granted above;
  • understand and acknowledge that Sitetracker may develop or commission materials similar or identical to your submission and you waive any claims you may have resulting from any similarities to your entry;
  • understand that you will not receive any compensation or credit for use of your entry, other than what is described in these Official Rules.

Please note that following the end of this Contest the details of your entry may be posted on a website for viewing by visitors to that website or included in press. We are not responsible for any unauthorized use of your entry by visitors to this website. While we reserve these rights, we are not obligated to use your entry for any purpose, even if it has been selected as a winning entry.

If you do not want to grant us these rights to your entry, please do not enter this Contest.

FINALIST AND WINNER DETERMINATION OF AWARDS

On or around the close of the Entry Period, a panel of judges will review all eligible entries received and select up to three (3) runner-up finalists for each Award and one winner for each Award described below based upon the following judging criteria:

  • Originality (50%) 
  • Industry Relevance (25%)
  • Overall Impression (25%)

Finalists and winners will be contacted on or about November 1, 2019 to the e-mail address, or the phone number, provided at time of entry and must agree at that time to participate in the Awards Dinner (described below). We will make up to two (2) attempts to contact each finalist and winner to confirm their participation. If we are unable to make contact, we will notify the next runner-up finalist and give that company the opportunity to verify their participation.

The individual that made the submission for a company award will attend the Awards Dinner and be the representative for the company, unless the company delegates another employee. The person that was nominated for an individual award will attend the Awards Dinner. The person that nominated an individual will not receive a prize.

Finalists and winners will receive the prize described below.

PRIZES 

Each winner will receive a 2-day / 1-night trip to Las Vegas. The trip includes:

  • Round trip coach air transportation for winner from an airport near winner’s home within the U.S. to airport in Las Vegas, Nevada (airport, carrier and itinerary selected by Sponsor).
  • Hotel accommodations for one (1) night at a hotel in Las Vegas (as selected by Sponsor).
  • Admission to Awards Dinner on November 20, 2019.

Additional prize details:

  • Winner must travel to Las Vegas on November 20, 2019 and depart Las Vegas on November 21, 2019. Winner’s flight must get them to Las Vegas in time for the Awards Dinner. If the date for Awards Dinner is changed then the date of travel will also change. If winner is not able to travel on stated dates prize will be forfeited and no other consideration will be provided.
  • The Approximate Retail Value of each prize is $350.00 Actual prize value depends on the location of the winner’s residence and dates of travel.
  • If winner lives within 150 miles of Las Vegas ground transportation may be provided instead of air transportation, at Sponsor’s sole discretion. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, baggage fees, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of winner. Any picture identification requirements associated with air travel are the winner’s responsibility. No warranty or guarantee will be given by Sponsor with respect to the prize. Any and all guarantees and warranties are subject to the manufacturers or service provider’s terms and conditions, and the winner agrees to look solely to such entity for any such warranty or guarantee claim. Prize is non-transferable, unless agreed to in writing by Sponsor. No substitution, cash redemption, assignment or transfer of prize permitted, except by Sponsor, who reserves the right in its sole discretion to substitute a prize with another prize of greater or equal value. All federal, state and local taxes, if any, related to a prize are the responsibility of the individual winner.
  • You and up to 2 other co-worker guests are welcome to attend the evening. Guests will not be eligible for reimbursement of flight or hotel costs, but they will be able to enjoy the night, including the dinner and experience planned. 
  • If you nominate an individual at your company, you and your nominee are eligible to be flown out to Las Vegas for the awards evening.

All finalists and Award winners will receive the prize described above. The Award winners will be recognized during the Awards Dinner as the winner.

CONTEST AWARDS

The Sitetracker Industry Awards “Heroes of Telecom” are:

  1. Most Innovative Telecom Company (company award)
  2. Best Corporate Responsibility (company award)
  3. Best Company Culture (company award)
  4. Project Manager of the Year (individual award)
  5. Most Influential Woman in Telecom (individual award)

One (1) winner will be recognized for each of award. Up to three (3) runner-up finalists will be named for each award.

WHAT OTHER CONDITIONS AM I AGREEING TO BY ENTERING? 

By clicking the “Count Me In” button in the Sitetracker Industry Awards “Heroes of Telecom” submission process for submitting an entry, you hereby acknowledge and agree:

  • To abide by these Official Rules; and
  • To release and hold harmless Sitetracker and its respective parents, subsidiaries, affiliates, employees and agents from any and all liability or any injury, loss or damage of any kind arising from or in connection with this Contest, or any prize won; and
  • That Sitetracker’s decisions will be final and binding on all matters related to this Contest; and
  • That Sitetracker may use of your proper name and company’s logo online and in print, or in any other media, in connection with this Contest, without payment or compensation to you, except where prohibited by law.
  • Finalists and winners should be prepared to provide additional materials required for editorial or promotional purposes and to help promote the Awards Dinner. Additional materials may include, but are not limited to, screen images, photographs of the development team, company logo (both on disk and a high-resolution printout), and video source.
  • Finalists and winners consent to having photos taken of them and being included in media and press as either a winner of Finalist of Sitetracker Industry Awards “Heroes of Telecom”.

WHAT LAWS GOVERN THE WAY THIS CONTEST IS EXECUTED AND ADMINISTRATED?

This Contest will be governed by the laws of the State of New York, and you consent to the exclusive jurisdiction and venue of the courts in New York County, New York for any disputes arising out of this Contest.

WHAT IF SOMETHING UNEXPECTED HAPPENS AND THE CONTEST CAN’T RUN AS PLANNED? 

If someone cheats, or a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) affects the fairness and / or integrity of this Contest, we reserve the right to cancel, change or suspend this Contest. This right is reserved whether the event is due to human or technical error. If a solution cannot be found to restore the integrity of the Contest, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Contest.

If you attempt to compromise the integrity or the legitimate operation of this Contest by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future Contest, so please play fairly.

HOW CAN I FIND OUT WHO WON?

Entrants can find out who won by visiting https://www.sitetracker.com/telecom-heroes/ where the names of the Contest’s winners will remain posted for 3 months after November 25, 2019.
